14Bisness – Terms & Conditions for Licenses and Services
This License and Services Terms & Conditions and any amendments thereof is an integral part of 14Bisness – Base de Inovações e Soluções S/S Ltda (14Bisness, US, OUR), registered in Federal District, Brazil under CNPJ 07.083.331/0001-67 and Insc.-DF 07.798.442/001-00 Terms of Service & Privacy Policy (ToS & PP) Digital Platforms which is available at www.14bisness.com .
These terms & Conditions are part of a contract between YOU (USER) and 14Bisness.
By using 14Bisness Platforms, purchasing license of OUR digital products/content, OUR online service or subscribing to OUR services, YOU accept these ToS & PP and agree to comply with all of its provisions. If YOU do not wish to accept these ToS & PP, do not use our platforms, purchase our products or subscribe to OUR services.
14Bisness Digital Product License
The license terms and conditions stated herein grant non-exclusive rights to AUTHORIZED USERS for using the product(s)/service(s) offered by 14Bisness in any form and is applicable to all orders processed by 14Bisness. The agreement is related to YOUR use of the products and services offered by 14Bisness. By placing the order, an individual “YOU”, on his/her own or on behalf of an organization, agrees to the 14Bisness License Terms. The License Terms shall be binding upon the USER upon acceptance of the delivery by downloading 14Bisness´ digital products and by participating in online web conference for consulting service session provided by 14Bisness (Spot Consulting).
Single-User License: By ordering a “Single-User License,” YOU agree the 14Bisness is granting to YOU one non-exclusive, non-transferable machine-readable license for the digital content electronically. The right to store, display, use, or stockpile the digital product is restricted to only ONE authorized computer. For obtaining a single user license, ONLY an individual (“YOU”) is entitled to using the product or as mentioned in the License Terms. Any individual representing an organization is refrained from accessing the products/services of 14Bisness or as stated in the License Terms; any breach of which shall lead to violation of applicable laws in Brazil or in the jurisdiction of purchase.
The products and services offered are part of the intellectual property assets of 14Bisness, and are protected by applicable copyright laws, international treaty provisions, and other applicable laws of the country in which these are being used. Albeit the abovementioned, YOU are NOT be permitted to:
● transmit or permit any third party to use and/or gain access to the report;
● resell, sub-license, rent, lease, transfer, or attempt to assign the rights of the digital product/content (in whole or in part) to any party NOT authorized by 14Bisness;
● modify, alter, create database, broadcast, communicate, transfer, pledge, rent, reproduce, transmit, display, copy, distribute, commercially exploit, use, or store the content from the report other than for internal business purposes; expressly permitted above;
● use the digital product content in any comportment that would breach the terms and conditions contained in these License Terms or that would violate the applicable laws in Brazil or in any other jurisdiction;
● take photocopies, share with non-authorized users, and/or copy content from this publication to further distribute for commercial/noncommercial gains;
● share the information or content either electronically or in printed form with fellow-mates, public libraries, researchers, lecturers, college, university, foundation, government agency, corporate, a non-profit organization, or any other unauthorized users.
14Bisness Online Consulting Service
By online booking a 14Bisness consulting service made available to YOU by a third-party digital platform YOU agree to choose a date and time available that suits YOU and pay within 48 hours to confirm your session. YOU will receive an electronic confirmation message of YOUR online consulting session with a web conference details and a link with questions and that should be answered prior to the meeting.
YOU are required to be sure you are in a fast, stable internet connection, in an environment free of distractions with high-quality headphones, mic and video to allow the online session with 14Bisness consultant.
YOU can cancel or reschedule for free YOUR online consulting session up to 48 hours before YOU session by contacting 14bisness at email: contact@14bisness.com. After this period, rescheduling and refunds will not be available, with the exception of unavoidable accidents that are duly informed.
In the event 14Bisness needs to cancel a session, YOU will be informed and may choose to book a new date and time or be fully refunded.
Ordering 14Bisness Licensed Digital Content and Online Services
YOU agree that orders of digital licensed product and online consulting services may be placed by YOU through the website at www.14bisness.com by using an order or booking form (whether provided on the website or made available to YOU by a third party).
YOU agree that for digital content YOU have up to 30 consecutive days from 14Bisness payment confirmation date to perform the YOUR licensed download by the link provided by 14Bisness. After this period the given download link will expired, and no download will be available. 14Bisness digital content downloaded by YOU consist in proof of full delivery by 14Bisness of the digital product paid by YOU and will not be refunded by the 14Bisness.
Booking 14Bisness Online Consulting Service
For online consulting service (Spot Consulting) YOU agree YOUR booking session must be paid at least 48 hours prior YOUR session with OUR selected expert consultant. If the due payment is not identified by 14Bisness the session will be automatically canceled by US.
Payment
YOU agree to pay 14Bisness for ordering digital content and online service through one of the following modes: PayPal, Credit Card or Bank Deposit/Wire Transfer.
Client’s financial information is kept private and secured. 14Bisness makes use of PayPal payment service, which provide protection against fraud and theft for buyers and sellers. PayPal website also provide security tips and tools against theft and website phishing and an easy process for reporting a problem. For more information, refer paypal.com website.
By using OUR website, YOU agree to allow third parties to process your IP (internet protocol) address, in order to determine your location for the purpose of currency conversion. YOU also agree to have that currency stored in a session cookie in your browser (a temporary cookie which gets automatically removed when YOU close your browser). WE do this in order for the selected currency to remain selected and consistent when browsing OUR website so that the prices can convert to YOUR local currency.
Fees
YOU agree all fees should be paid by YOU as per the terms of payment mentioned in the applicable order. 14Bisness has the discretion to cancel access to the product license and service in case the full payment has not been received by 14Bisness within the stipulated time.
Taxes
All prices charged by the 14Bisness include services fees and Brazilian taxes. However, YOU agree to be of your sole responsibility to pay any additional tax if charged on YOUR jurisdiction. This payment will exclude taxes levied on the income of 14Bisness.
Intellectual Property Rights
14Bisness owns all rights to the intellectual property and material contained on OUR Platforms, and all such rights are reserved. As an YOU agree that YOU are granted a limited license only, subject to the restrictions provided under 14Bisness full Terms of Service and Privacy (ToS & PP).
The content available on OUR Platforms is protected by Intellectual Property rights and/or Personality Rights. Such protection includes, but is not limited to, brands, articles, texts, photos, images, videos, layouts, etc. and their unauthorized reproduction is prohibited. Trademarks and trade names of third parties remain the ownership of those third parties and may not be used without the permission of their respective owners. We reserve the right to seek law enforcement in the exercise of OUR own rights.
YOU agree that under 14Bisness ToS & PP, any content submitted and include by YOU at any time to or through any of OUR Platforms becomes OUR sole and exclusive property. The format of the Content can be in any medium of expression including writing, image, video, sound and voice. All Submitted Content is deemed to be, and warranted by YOU to be, non-confidential and non-proprietary and YOU agree that We may use, disclose or otherwise exploit them in any manner. If this particular part of OUR ToS & PP do not apply to YOUR jurisdiction then YOU hereby grant to US a non-exclusive, royalty-free, perpetual, transferable, and sub-licensable license to copy, transmit, use, create derivative works from or otherwise exploit all Submitted Content. YOU also agree that WE are not responsible for the conduct of other users of OUR Platforms or any third parties with whom YOU or WE share YOUR Submitted Content.
14Bisness is committed to remove from OUR Platforms photos, images, videos, etc., whose rights may be claimed and proven by third parties particularly expressing their opposition to such publication.
Governing Law & Jurisdiction
These Terms of Service and Privacy Policy will be governed by and construed in accordance with the laws of Brazil, and YOU submit to the non-exclusive jurisdiction of the state and federal courts located in Brasilia, Federal District for the resolution of any disputes.
